The U.S. Department of Justice has appealed to the 6th Circuit Court of Appeals to reinstate human smuggling charges against Kilmar Abrego Garcia. The charges, stemming from a 2022 Tennessee traffic stop, were dismissed in May 2026 by U.S. District Judge Waverly David Crenshaw Jr., who ruled the prosecution was a vindictive retaliation for Abrego Garcia successfully challenging his wrongful 2025 deportation. The DOJ denies any vindictive motive, asserting career prosecutors acted on clear evidence, while Abrego Garcia's defense team maintains the case was a politically motivated White House vendetta.
